1. Who we are
Evita GyneCare Clinic (registered as Evita GyneCare Hospital & Research Institute) is an outpatient obstetrics and gynaecology clinic at Burma Camp, Rainbow Colony, Dimapur – 797112, Nagaland, led by Dr. Emmanuel L. Yanthan, MS (OB-GYN), NMC Reg. No. NMC/R-26/00129. In this policy, “we”, “us” and “the clinic” mean Evita GyneCare Clinic, and “you” means a patient, a person enquiring about care, or a visitor to this website.
The clinic decides why and how your personal information is used. Under Indian data-protection law it is the “body corporate” responsible for your sensitive personal data and the “data fiduciary” for your personal data.
2. What this policy covers
This policy applies to information we collect through this website, by phone, by WhatsApp or other messages, and at the clinic. It does not cover other websites we link to, such as Google Maps, or separate businesses at the same premises, such as the on-site pharmacy, which handle information under their own policies.
3. Laws we follow
- The Information Technology Act, 2000 (section 43A) and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
- The Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025, as their provisions come into force (most from 13 May 2027). Where we can already give you the rights they describe, we do.
- The Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002, applied by the National Medical Commission, including the duty of medical confidentiality.
- The Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994 and its Rules. This centre is registered under that Act (Reg. No. DMR/PNDT/038/25, valid until 27 May 2030).
- The Telemedicine Practice Guidelines, 2020, for any advice given by phone, video or message.
- The Protection of Children from Sexual Offences Act, 2012, the Nagaland Health Care Establishments Act, 1997, and other laws that require us to keep records or report information.
4. Information we collect
| Category | Examples | How we get it |
|---|---|---|

| Health information | Medical, menstrual, obstetric and family history; symptoms; examination findings; ultrasound images and reports; laboratory results; diagnoses; prescriptions; referral letters | From you, from your examination and tests, and from reports you bring |
| Pregnancy-scan records | Consent forms, declarations and registers required by the PC&PNDT Act | Completed at the clinic before a pregnancy scan |
| Communications | Messages, voice notes, photos or documents you send us on WhatsApp, and notes of phone calls | From you |
| Payment details | Amount paid, date, method (cash, UPI or card) and receipt number. We do not store full card numbers or UPI PINs | At the clinic desk, through bank-provided payment terminals and UPI apps |
| Website data | This website does not store forms or use analytics or advertising cookies. Fonts from Google Fonts and the map from Google Maps receive your device’s IP address when a page loads | Automatically, by those services |
Health, physiological and medical-record information is sensitive personal data under the 2011 Rules, and we handle it with the additional care those Rules require.
5. Why we use your information
| Purpose | Legal basis |
|---|---|
| Arranging, confirming and reminding you of appointments | Your consent |
| Taking your history, examining you, carrying out tests and providing treatment and follow-up | Your consent, and our professional duty of care |
| Keeping medical, pregnancy-scan and billing records | Legal obligation |
| Referring you to a specialist, laboratory or hospital | Your consent |
| Responding to a medical emergency that threatens your life or health | Permitted by law without prior consent |
| Reporting to authorities, responding to inspections, court orders and legal claims | Legal obligation |
| Answering your questions, requests and complaints | Your consent and our legal obligations |
We do not use your information for advertising or marketing, we do not sell it, and we do not use it to ask for reviews or testimonials.
6. Your consent
We ask for your consent before collecting sensitive personal data, for example by the consent box on our booking form, by registration at the clinic, or by written consent before an examination or scan. You can withdraw consent at any time by telling us at the clinic, by phone, or by replying STOP to our messages. Withdrawing consent does not affect care already given, and we will still keep the records the law requires us to keep. If you withdraw consent to us holding the information needed to treat you safely, we may not be able to continue your care and will explain the options.
7. Who we share it with
- You, and anyone you authorise in writing, such as a family member.
- Others involved in your care — laboratories, imaging centres, specialists and hospitals you are referred to, including the hospital where you plan to deliver — only the information they need.
- A pharmacy you choose, if you ask us to send a prescription. You may use any pharmacy.
- Service providers that help us run the clinic, such as WhatsApp (operated by Meta Platforms) for messages, telecom providers, our website host, and banks or payment providers. They may use the information only to provide that service.
- Authorities, when the law requires it — for example the Appropriate Authority under the PC&PNDT Act, public-health reporting of notifiable diseases, mandatory reporting under the POCSO Act to protect a child, police or courts acting under law, and regulators carrying out inspections.
Apart from these, we will not disclose your information without your consent.
8. Information stored outside India
Some service providers, including WhatsApp and Google, may store or process information on servers outside India. Such transfers are permitted under Indian law except to countries the Government restricts, and we will follow any such restriction.
9. Cookies and this website
This website does not set its own cookies and does not use analytics, advertising or tracking tools. The booking form does not send or store anything on this website: it prepares a message and opens WhatsApp, and nothing reaches us until you press send there. The embedded Google map and Google Fonts are provided by Google and are covered by Google’s privacy policy. If we add analytics in future, we will update this section first.
10. Children and young people
We see patients under 18 with a parent or guardian, whose consent we ask for before collecting or using the young person’s information. Part of a consultation can be with the doctor alone. The doctor will explain what can stay private and what the law requires us to share or report to keep a young person safe.
11. How long we keep it
| Record | How long we keep it |
|---|---|
| Medical records (history, notes, test results, prescriptions, referral letters) | At least 3 years from your last visit, and longer while your care continues or a legal claim is possible or pending |
| Pregnancy-scan records required by the PC&PNDT Act | At least 2 years from the scan, or until any legal proceedings are finished, whichever is later |
| Billing and payment records | As long as tax and accounting laws require, generally up to 8 years |
| Advice given by phone, video or message | As part of your medical record |
| Enquiries that did not lead to a visit | Deleted within 12 months |
When information is no longer needed, we delete or securely destroy it, unless the law requires us to keep it longer.
12. How we protect it
- Only staff who need your information for your care or for clinic administration can see it, and all staff are bound by medical confidentiality.
- Paper records are stored securely at the clinic. Electronic records and the clinic’s WhatsApp account are kept on clinic devices protected by passwords or PINs.
- Examinations take place in a private room, and a female staff member or nurse is present for every intimate examination.
- Card and UPI payments are processed by banks and payment apps; we do not store full card numbers or PINs.
- We review these safeguards regularly.
No method of storage or transmission is completely secure. If a breach affects your personal data, we will inform you and the authorities as the law requires, including the Data Protection Board of India once those duties are in force, and CERT-In where its directions apply.
13. Your rights
- Access and copies. You can ask for a summary of the personal information we hold and for copies of your medical records. We aim to provide copies of medical records within 72 hours of a request.
- Correction and updating. You can ask us to correct information that is inaccurate or incomplete.
- Erasure. You can ask us to delete information we no longer need, unless the law requires us to keep it.
- Withdraw consent. As described in section 6.
- Grievance redressal. You can complain to our grievance officer (section 15).
- Nomination. You can nominate a person to exercise these rights on your behalf if you die or become unable to act.
To use these rights, contact the grievance officer. To protect your information, we will confirm your identity before acting on a request.
14. Your responsibilities
Please give us accurate information, tell us if your details change, and do not give us information about another person without their permission.
